First off, I have to say: Happy Birthday, Wayne! (and Happy Birthday yesterday to Beck and tomorrow to Jay and Meloney!) Life has been busy as usual--my sister had another baby girl (Catherine Emily--known as Catie Bug), Mark started chemo and was dropped from the study (*sigh*), Alex and I have both been taking swimming (but she's learning the fun stuff like blowing bubbles in the water; I just get to swim from one side to the other for an hour). Oh, and about a month ago or so, I--in my "staff@elgonquin" guise--got an interesting email. On June 29, out of the blue, I received a message from someone named TR Host. It read: Yeesh. What had we done to piss off Time, Inc.?Attention Staff of Elgonquin: The following URL contains both logos and copyrighted material taken from The Rules boards and The Rules Book website both of which are under copyright by Time. http://www.elgonquin.com/archives/2000/03/18/Jennifer/ I would like to draw your attention to the following two paragraphs from Time Inc New Media's Rules of the Road found at http://www.pathfinder.com/help/hbb/rulesroad.html: "Ownership of Messages. By posting messages on the bulletin boards, you are granting Time Inc. a royalty free, perpetual, non-exclusive and irrevocable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any posting by you (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed. New Media cc: the user who brought this to my attention Fortunately, at about the same time, I also got another email out of the blue--this one by someone who's calling herself liatris here (Liatris is the botanical name for a flower I had in plant ID this spring--cool!). Liatris is a long-time participant on the bulletin boards Time runs in connection with the The Rules books (which are published by Time). There she tends to play a devil's advocate role at times, and this was one of the times where she wanted to make sure I got a fuller story than what I'd get from TR Host. Apparently, someone had just stumbled across Jennifer's set of posts from a year ago in March, where she used text from the bulletin boards to corroborate her opinions about The Rules and the women who followed them. That someone was not amused by Jennifer's conclusions, and particularly not amused that Jennifer quoted members of the bulletin board. (Liatris suspects, and I agree, that were Jennifer's entries flattering to The Rules, nobody would have suggested that she infringed on their copyright.) The emails started flying between me, Jennifer, and Harry. Any guesses what Harry's position was? How about Jennifer's? More on this in a couple of days. Cheryl |
